利用規約

本利用規約（以下「本規約」）は、{{SELLER_NAME}}（以下「当方」）が提供する建築ビジュアライゼーション向け SaaS「ArchVista」（以下「本サービス」）の利用条件を定めるものです。 利用者（以下「ユーザー」）は本規約に同意したうえで本サービスを利用するものとします。

ユーザーは正確かつ最新の情報を登録するものとし、メールアドレスおよびパスワード等の認証情報を第三者に共有してはなりません。 登録情報の不正使用に起因する損害について、当方は一切の責任を負いません。

ユーザーは以下の行為を行ってはなりません。

• 法令または公序良俗に反する行為
• 第三者の知的財産権、肖像権、プライバシー権、その他の権利を侵害する行為
• 違法な画像・テキストを生成する行為（児童ポルノ、テロ扇動、なりすまし等を含む）
• 本サービスのリバースエンジニアリング、または不正アクセス・負荷攻撃
• AI 生成機能を用いて、特定の実在人物の同意なくその肖像・声を再現する行為
• その他、当方が不適切と判断する行為

本サービスを通じて生成された画像、テキスト、その他コンテンツ（以下「生成物」）の著作権は、適用法令の許容する範囲においてユーザーに帰属します。 ただし、第三者の権利を侵害する生成物について当方は一切の責任を負わず、ユーザー自身の責任で利用するものとします。

現在、有料プランは提供していません。以下は、将来有料プランを提供する場合に適用される条件です。

本サービスの有料プラン（Solo / Pro / Pro Max 等）は月額のサブスクリプションとして提供され、価格はプラン一覧に表示します。決済は Stripe Inc. を通じて処理され、ユーザーは Stripe の利用規約にも同意したものとみなされます。

プランは Stripe カスタマーポータルまたは /billing ページからいつでも変更・解約可能です。解約は当該課金期間の終了をもって反映され、既に支払い済みの料金は原則として返金しません。

当方は、保守、障害、法令対応、その他合理的な理由により、本サービスの全部または一部を予告なく変更・停止することがあります。 これによりユーザーまたは第三者に損害が生じた場合でも、当方は責任を負いません。

本サービスは現状有姿で提供されます。当方は本サービスの正確性、完全性、特定目的への適合性、 生成された画像・テキストが第三者の権利を侵害しないことを保証しません。

当方の故意または重過失による場合を除き、本サービスの利用に関連して生じた損害について、 直近 12 ヶ月にユーザーが支払った利用料金の総額を上限として責任を負うものとし、 逸失利益等の間接損害については責任を負いません。

ユーザーの個人情報の取扱いについては、別途 プライバシーポリシー に定めるとおりとします。

本規約は日本法に準拠し、本サービスに関連する紛争については、{{COURT_NAME}}を第一審の専属的合意管轄裁判所とします。

当方は、必要に応じ本規約を変更することがあります。変更後の規約は、本ページに掲示した時点から効力を生じるものとし、 重要な変更については本サービス上の通知またはメールで事前にお知らせします。

These Terms govern your use of the ArchVista SaaS service operated by {{SELLER_NAME}} (“we”, “us”). By using the service, you agree to these Terms.

You agree to provide accurate registration information and to keep your authentication credentials confidential. We are not liable for unauthorized use of your account.

You shall not:

• Use the service for any illegal purpose or in violation of public order
• Infringe intellectual property, privacy, or publicity rights of any third party
• Generate illegal content (child exploitation material, incitement, impersonation, etc.)
• Reverse-engineer the service or attempt to disrupt its availability
• Generate likenesses of identifiable real persons without their consent

To the extent permitted by applicable law, you own the images, text and other content you generate through the service. You are responsible for ensuring your use of generated content does not infringe any third party rights.

Paid plans are not currently offered. The following applies if and when paid plans are made available.

Paid plans are subscription-based. Pricing is shown on the /billing page. Payments are processed by Stripe, Inc. and are subject to Stripe's terms. You may change or cancel your plan at any time via the Stripe Customer Portal; cancellations take effect at the end of the current billing period and prior payments are non-refundable.

We may modify or suspend the service at any time, including for maintenance, outage, or legal compliance, without prior notice. We are not liable for any resulting damages.

The service is provided “as is” without warranties of any kind. Except for our willful misconduct or gross negligence, our aggregate liability arising out of or related to the service is limited to the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or lost-profit damages.

These Terms are governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of {{COURT_NAME}} as court of first instance.

We may amend these Terms from time to time. Material changes will be announced via in-product notice or email before taking effect.
